DUI Checkpoint - Nystagmus

Ever wonder why the Police hold their pen or finger in front of your face going back and forth? It's called nystagmus and it a test to see how your eyes track.

So even though you tell the officer "I only had one drink".... he (or she) can tell if that was a really big drink by the way your eyes track.

You cannot control your eyes.... unless you close them and don't look.

Glad you asked. Only the driver really knows what he or she had to drink. The purpose of the checkpoint is to find those drivers too impaired to drive. This is accomplished with a field sobriety test that usually includes a breath test to determine the blood alcohol level and whether or not the person is over the legal limit of .08.

It is not about the number of drinks, since that varies based on the size of the drink and its contents, the frequency between drinks, amount of food eaten and the size of the person. The real issue, is whether or not they are a danger behind the wheel.
